Section 11 Compliance
Section 11 of the Children Act 2004, places a duty on key persons and bodies to make arrangements to ensure that in discharging their functions, they have regard to the need to safeguard and promote the welfare of children.
Where a private, voluntary or independent organisation is commissioned to provide services on behalf of a statutory organsation, the agreement under which the arrangements are made should require that the private or voluntary organisation concerned takes this guidance into account in the provision of services.
This means that there is a duty on Oxfordshire County Council and other statutory bodies to ensure that any organisation commissioned by them for the provision of services to children; young people or families are compliant with the standards as defined in S11 of the Childrens Act 2004. To aid commissioners in this the OSCB has produced a self assessment tool for contracted or commissioned services and this related guidance. For those agencies registered with Ofsted, Compliance with these S11 standards does not remove the requirement to be compliant with standards as identified by Ofsted.
